Tenders Are Invited For Purchase Of Electricity, Sale Of Electricity From Renewable Energy Sources With A Trade Balancing Service

1. The Subject Of The Order Is The Purchase Of Electricity, Sale Of Electricity From Renewable Energy Sources Together With The Trade Balancing Service In The Planned Estimated Amount Of Approximately 1,005,455 Kwh (+/- 20%) In The Period From January 1, 2026 To December 31, 2026, To The Facilities Of The Entities Indicated In Point 1 Of These Terms Of Reference As The Ordering Party. The Value Of The Order Will Be Increased On The Basis Of Option Law. The Exercise Of The Option Right Applies To Each Of The Ordering Parties (Independently) Listed In Point. I Swz. Each Of The Ordering Parties Described In Point As Part Of The Option, I Swz May Order Additional Supplies Of Energy Up To The Equivalent Of 20% Of The Amount Of Electricity Ordered Under The Basic Order Indicated For Each Ordering Party In Annex No. 1 To The Agreement With The Contractor - Ppe Summary Table. Rules, Scope And Method Of Using The Option By The Ordering Party: A) The Ordering Party Is Entitled To Exercise The Option Right In The Event Of: - Adding Ppe (Need To Connect Additional Energy Consumption Points As A Result Of Changes In The Ordering Partys Infrastructure, Which May Result In An Increase In Demand For Electricity Supplies), - Necessity To Increase The Contractual Capacity For Existing Consumption Points In The Event Of Modernization Of Facilities Or The Need To Change Their Purpose.  The Need To Increase The Demand For Electricity During Periods Of Intensive Use (E.G. Winter Or Summer) Caused By, For Example, Increased Use Of Heating Or Air Conditioning.  Occurrence Of Crisis Situations Such As Pandemics Or Natural Disasters, Which May Force The Ordering Party To Increase Energy Supplies In Order To Ensure The Continuity Of The Ordering Partys Operations.  Occurrence Of Changes In Legal Regulations That May Introduce Additional Requirements Regarding Energy Consumption B) The Option Is Exercised Based On The Ordering Partys Unilateral Declaration Of Will, Indicating The Scope Of Changes Described In Point A Above, C) The Ordering Party May Use The Option Once Or More Than Once, Until The Value Indicated In § 6 Section 1 Point 2 Of The Agreement, D) The Option Will Be Settled At Unit Prices Based On The Terms Of The Submitted Offer For The Basic Order, Subject To The Changes In Remuneration Described In § 8 Of The Agreement, E) The Option Right Is A Right Of The Ordering Party, Which It May Exercise. If The Ordering Party Does Not Exercise The Option Right, The Contractor Is Not Entitled To Any Claims In This Respect. The Indicated Amount Of Electricity Is An Estimate And May Change Depending On Actual Needs. The Ordering Party Reserves The Right Not To Use The Entire Order During The Contract Period, But Guarantees The Execution Of The Order At The Level Of At Least 80% Of The Planned Estimated Amount Of Electricity.
