1. The Subject Of The Order Is The Supply Of Electricity To The Facilities Of The Wawel Royal Castle - The State Art Collections. The Sale Of Electricity Must Be Carried Out In Accordance With Applicable Law, In Particular The Provisions Of The Act Of April 10, 1997. Energy Law (I.E. Journal Of Laws Of 2024, Item 266, As Amended) And Implementing Acts Issued On Its Basis. The List Of Energy Consumption Points Together With The Specification Of Energy Consumption Is Detailed In The List Of Epp (Energy Consumption Points) Constituting Annex No. 2 To The Specification. The Ordering Party Has A Legal Title That Authorizes It To Freely Dispose Of The Facilities Described In The Subject Of The Order. 2 Distribution Services Will Be Provided On The Basis Of A Separate Agreement Concluded With The Dso (Distribution System Operator), I.E. Tauron Dystrybucja S.A., From Whose Networks The Individual Ppes Are Supplied. 3 Contracts For The Provision Of Electricity Distribution Services Will Be Concluded By The Ordering Party On Its Own. 4 The Contractor Will Be Obliged To Submit The Above-Mentioned Dso, On Behalf Of The Ordering Party, To Report The Conclusion Of A Contract For The Sale Of Electricity. The Expected Amount Of Energy Supplied During The Duration Of The Contract (From January 1, 2026 To December 31, 2026) Is 1,400,000.00 Kwh - Division Into Individual Ppes In Annex 2. The Indicated Amount Of Electricity Is Only An Approximate Value. The Actual Consumption Of Electricity Will Depend Solely On The Actual Needs Of The Ordering Partys Individual Ppes, However, Regardless Of The Amount Of Consumption, The Contractor Is Obliged To Use The Unit Energy Prices Offered In The Offer In Each Case. 5 The Contractor Will Also Be Obliged To Act As The Entity Responsible For Commercial Balancing For The Electricity Sold Under The Contract. The Contractor Will Perform Commercial Balancing Of The Energy Purchased By The Ordering Party Based On The Standard Consumption Profile With The Contractual Power Specified In Annex No. 2 To The Specification. The Costs Resulting From Balancing Must Be Included In The Price Of Electricity. The Ordering Party Declares That All Rights And Obligations Related To Trade Balancing Under The Contract, Including Reporting Trade Schedules To The Dso, Are Transferred To The Contractor. 6 The Contractor Undertakes To Provide The Ordering Party With Quality Standards Of Service Regarding The Subject Of The Order In Accordance With The Applicable Provisions Of The Energy Law And In Accordance With The Applicable Regulations Regarding Maintaining Quality Standards. 7 Customer Service Quality Standards Are Specified In The Applicable Implementing Regulations Issued On The Basis Of The Act Of April 10, 1997. – Energy Law (I.E. In The Event Of Failure To Meet Quality Service Standards, The Ordering Party Is Entitled To Discounts According To The Rates Specified In § 42 Of The Regulation Of The Minister Of
