Task No. 1 - Purchase, Delivery And Transfer Of A Musical Instrument: Flute Altus A9 Rbe Os Or An Equivalent Instrument Meeting The Criteria Specified In Annex No. 3.1 To The Swz In The Scope Of Task No. 1. The Ordering Party Plans To Purchase 2 Pieces Of This Musical Instrument. The Parameters Of Musical Instruments For Task No. 1 To No. 11 Are Described Separately In Annex No. 3.1 To The Swz, And For Task No. 12 In Annex No. 3.2 To The Swz And Constitute The Minimum Requirements Of The Ordering Party. Failure To Meet The Minimum Requirements Will Result In Rejection Of The Offer As Inconsistent With The Terms Of The Contract Pursuant To Art. 226 Section 1 Point 5 Of The Public Procurement Law. The Ordering Party Does Not Consent To Changing The Delivered Product To A Product Other Than That Offered In The Offer Form Constituting Annex No. 1 To The Swz, Subject To The Reservation Below. The Ordering Party Agrees To Change The Delivered Product To One Other Than The One Offered In The Offer Form In Cases Where The Contractor Demonstrates That The Offered Product Range Has Been Withdrawn From Sale Or Its Production Has Ceased, There Is No Access To It On The Polish Market (Confirmed By The Manufacturer Or Sales Representative On The Polish Market). The Ordering Party Allows The Possibility Of Offering And Delivering A Different Product Range, Provided That Its Technical Parameters Are Not Worse Than Those Of The Offered Product, And The Unit Price Is Not Higher Than That Offered In The Offer Form. In The Case Referred To Above, The Contractor Must Provide The Instrument For Testing And Obtain The Ordering Partys Consent To Change The Offered Instrument. The Ordering Party Has The Right Not To Consent To Changing The Offered Instrument. In Such A Case, The Contractor Will Be Obliged To Deliver The Offered Instrument Consistent With The Content Of The Offer. The Ordering Party Will Provide The Contractor With Consent Or Lack Thereof In Writing. The Offer Price Should Include The Purchase, Delivery And Carrying Of The Instrument To The Room Indicated By The Ordering Party. The Ordering Party Informs That Deliveries Will Be Made To The Kwp Katowice Premises, Ul. Koszarowa 17, Building No. 10. The Ordering Party Requires That The Entire Assortment Be Brand New, Grade I, Not For Exhibition, Not Refurbished, Manufactured No Earlier Than 2024 With Confirmation Of The Production Date Issued By The Manufacturer, Provided By The Contractor On The Day Of Receipt Of The Instrument, And Meet The Requirements Specified In The Description Of The Subject Of The Order. – Annex No. 3.1-3.2 To The Swz. The Ordering Party Requires The Contractor To Indicate The Manufacturer, Symbol Or Other Additional Data Enabling Clear Identification Of The Offered Musical Instrument In Annex No. 1 To The Swz. Failure To Enter The Manufacturer, Symbol Or Other Additional Data Enabling Clear Identification Of The Offered Instrument In The Offer Form Will Result In Rejection Of The Of
