Gaseous Fuels – Comprehensive Supply Of Gas Fuel. 1. The Subject Of The Order Is The Provision By The Contractor To The Ordering Party Of A Comprehensive Supply Of Gas Fuel, Consisting In The Sale Of Gas Fuel And Ensuring The Provision Of Its Distribution Service, To Installations Located In The Ordering Partys Facilities, Hereinafter Referred To As Reception Locations, The List Of Which Is Included In Annex No. 1 To Swz I. 2. Forecasted Demand For Gas Fuel For The Period From January 1, 2026 To December 31, 2027 Is Indicated In Annex No. 2.A To Swz I. A) The Demand For Gas Fuel Takes Into Account The Division Into Ppgs Subject To The Act Of January 26, 2022 On Special Solutions For The Protection Of Gas Fuel Consumers In Connection With The Situation On The Gas Market; B) At The Stage Of Signing The Contract, The Ordering Party Will Submit Appropriate Declarations From The Gas Fuel Recipient About The Purpose Of The Gas Fuel On The Template Proposed By The Contractor (Based On The Regulation Of The Minister Of Climate And Environment Of January 28, 2022) Confirming The Declarations On The Percentage Consumption Of The Volume Subject To Protection Contained In Annex No. 1 To Swz I. 3. The Given Volume Of Gas Fuel Specified In Paragraph 2 Is An Estimated Value Based On Current Consumption And Is Used Only For Comparison And Evaluation Of Offers. The Ordering Party Reserves The Right To Reduce Or Increase The Total Volume Of Gas Fuel In Relation To The Quantity Specified In Section 2 In The Amount Of +/- 10%. Possible Change Of The Estimated Consumption Specified In Section 2 Will Not Result In Additional Costs For The Ordering Party, Apart From The Settlement For The Actual Amount Of Gas Fuel Consumed. 4. The Order For Gaseous Fuel In Individual Gas Months And The Contracted Capacity Order Are Specified In Annex No. 1 To Swz I. 5. The Comprehensive Supply Of Gaseous Fuel Will Take Place Under The Conditions Specified In The Provisions Of The Ep Act And In Accordance With The Implementing Regulations Issued Thereto. 6. The Gas Fuel Distribution Service To The Collection Points Will Be Carried Out Via The Distribution Network Belonging To The Local Dso. 7. The Contractor Selected In The Proceedings Is Obliged, On The Basis Of The Power Of Attorney Granted By The Ordering Party, To: A) Submit On Behalf Of The Ordering Party The Comprehensive Gas Fuel Supply Agreement To The Dso In Order To Implement The Concluded Comprehensive Gas Fuel Supply Agreement, B) Terminate The Existing Comprehensive Gas Fuel Supply Agreements, Or Submit A Declaration Of Termination Of The Comprehensive Gas Fuel Supply Agreements By Mutual Agreement Of The Parties, C) Make All Activities And Arrangements With The Dso And The Current Supplier Necessary To Carry Out The Supplier Change Procedure And Effectively Commence The Comprehensive Supply Of Gas Fuel.
