1. The Subject Of This Order Is The Comprehensive Supply Of Electricity, Including The Sale Of Electricity And The Provision Of Electricity Distribution In The Years 2026-2027 To The Ordering Partys Facilities Under Its Direct Management, Listed In The Price Form, Constituting Annex No. 3 To Swz.2. Total Estimated Electricity Demand For The Facilities Listed In Annex 3 To The Swz, In The Period From January 1, 2026. Until December 31, 2027 Is 383,095.65 Kwh.3. The Estimated Energy Demand Provided In The Price Form And The Gross Price For The Entire Order Are Only Used To Compare Offers And Select The Contractor Based On The Most Advantageous Of The Presented Offers.4. The Ordering Party Reserves The Right To Reduce The Quantities In Question. The Contractor Will Not Make Any Claims Against The Ordering Party In This Respect. The Settlement Will Be Based On The Actual Consumption Of Electricity Based On Current Readings Of Measurement And Billing Systems According To The Fee Rates Resulting From The Submitted Offer And The Tariff Of The Distribution System Operator.5. As Part Of These Proceedings, The Contractor Is Obliged To Sell Electricity And Provide Electricity Distribution Services To Consumption Points Administered By The Kalisz County.6. The Electricity Sales Rates (Including The Commercial Fee) Included In The Price Form Constituting Annex No. 3 To The Swz Are At A Constant Level Throughout The Duration Of The Contract, While The Distribution Fees Are Variable And Their Amount Depends On The Distribution Rates In Accordance With The Currently Applicable Tariffs Of The Distribution System Operator (Dso Tariff), Approved By The President Of The Energy Regulatory Office And Generally Applicable Legal Provisions.7. The Contractor Determines The Amount Of The Distribution Fee In The Price Form, Based On The Currently Applicable Rates And Fees On The Date Of Submission Of Offers.8. The Ordering Party Undertakes To Receive At Least 50% Of The Estimated Amount Of Electricity Specified In Point 2.9. Electricity Is Currently Supplied To All Consumption Points On The Basis Of A Comprehensive Contract.10. The Contractor Must Have A Current License To Conduct Business Activities In The Field Of Electricity Trading, Issued By The President Of The Energy Regulatory Office And A Current License To Conduct Business Activities In The Field Of Electricity Distribution, Issued By The President Of The Energy Regulatory Office (Applies To Contractors Who Are Owners Of The Distribution Network) Or A Statement That It Has A Valid Contract Concluded With The Distribution System Operator, Hereinafter Referred To As Dso, Under Which The Dso Ensures The Provision Of Distribution Services To The Ordering Party (Applies To Contractors Who Do Not Provide Electricity Distribution Services).11.
