The Subject Of The Order Is The Reconstruction And Modernization Of The Playground At The Childrens Club In Lubichów By Retrofitting The Existing Playground Belonging To The Maluszek Childrens Club In Lubichów. 2. The Detailed Scope Of The Subject Of The Order Includes: 1) Design Documentation: Bill Of Quantities, Design. 2) Technical Specification For The Execution And Acceptance Of Construction Works. Note: The Bill Of Quantities Plays Only An Auxiliary Role In Calculating The Offer Price By The Contractor. If Any Works Are Not Included In The Bill Of Quantities And Are Necessary For The Proper Execution Of The Order, The Contractor Should Value Them And Include Them In The Offer Price. 3. The Subject Of The Order Also Includes: 1) Implementation Of The Conditions Specified In The Opinions, Arrangements, Decisions, Permits, 2) Measurement Works For Linear Earthworks - Marking Out By An Authorized Surveyor, 3) Preparation Of An As-Built Cost Estimate. 4. The Works Should Be Performed And Completed In Accordance With The Principles Of Technical Knowledge And The Provisions Of Generally Applicable Law In Force In The Republic Of Poland And The Requirements Of The Ordering Party, And The Management And Supervision Of The Works May Be Performed By Persons Who Have The Required Qualifications And Are Insured Against Civil Liability. 5. The Investment Whose Implementation (Construction Work) Is The Subject Of The Contract Constitutes A Whole. In This Case, The Construction Work (Reconstruction And Modernization Of The Playground) Must Fulfill A Technical And Functional Function In Accordance With Its Intended Purpose. Therefore, It Is Advisable That The Construction Works Be Performed By One Contractor Due To The Closely Related Elements Including The Reconstruction And Modernization Of The Playground And Due To Technological Rigors And The Required Guarantee Of Delivery Quality. A Possible Division Would Result In A Disproportionate Number Of Coordination And Acceptance Activities, And Any Problems With One Of The Contractors Could Directly Affect The Ability Of Other Contractors To Carry Out Construction Works, Which Would Threaten The Proper Implementation Of The Task And Would Result In Subsequent Unjustified Additional Actions During The Warranty Period Granted By The Contractors. 6. Equivalent Solutions: 1) If The Ordering Party Has Indicated In The Description Of The Subject Of The Order Trademarks, Patents Or Origins, Sources Or A Specific Process That Characterizes The Products Or Services Provided By A Specific Contractor, It Is Allowed To Offer Solutions Equivalent To Those Described, Provided That They Maintain The Same Minimum Technical, Quality And Functional Parameters; 2) A Contractor Who Refers To Equivalent Solutions Is Obliged To Demonstrate That The Solution He Offers Meets The Requirements Specified By The Ordering Party. In Such A Case, The Contractor Attaches To The Offer A List Of Equivalent Solutions Along With Its Description
