1. The Subject Of The Order Is The Purchase Of A Power Generator And Its Installation For The Śliwice Commune As Part Of The Cybersafe Local Government Grant Project.2. Order Co-Financed By The European Fund For Digital Development 2021-2027 (Ferc) Priority Ii: Advanced Digital Services Measure 2.2. – Strengthening The National Cybersecurity System, Grant Competition Under The Cybersecure Local Government Grant Project Number Ferc.02.02-Cs.01-001/23 And The State Budget. 3. The Scope Of The Order Includes A Stationary Power Generator In The Built-In Version With A Diesel Engine, Fuel: Diesel Oil (Fuel Tank Located In The Frame Of The Generator) With A Power Of Min. 150 Kva / 120 Kw.4. A Detailed Description Of The Subject Of The Order Is Included In The Description Of The Subject Of The Order Constituting Annex No. 4 To Swz.5. The Subject Of The Order Includes The Delivery Of Brand New Equipment, Its Scope (Quantity And Parameters) Is Specified In Detail In Annex 4 To The Swz, Which Is A Detailed Description Of The Subject Of The Order.6. The Selected Contractor Is Obliged To Deliver, Unload, Bring, Assemble And Put Into Operation, In The Place Indicated By The Ordering Party, Brand New Devices, Free From Physical And Legal Defects, Indicated In Annex No. 1 To The Swz. The Devices Must Be Brand New - Manufactured No Later Than In 2024, Originally Packed, Undamaged, Must Come From The Manufacturers Authorized Sales Channel And Must Represent The Model Current Product Line. The Ordering Party Does Not Allow Refurbished (Refabricated), Demonstration Or Post-Exhibition Devices.7. The Contractor Is Obliged To Perform Deliveries With Due Diligence, In Accordance With Applicable Regulations, Standards, Provisions Of The Agreement, Taking Into Account Occupational Health And Safety Requirements, Organization And Implementation Of The Contract Without Disruptions.8. The Contractor Is Obliged To Provide The Ordering Party With Technical Documentation Of The Offered Equipment, All Necessary Instructions For Use, Certificates Of Compliance Required By Law And Warranty Documents In Polish. For Software Supplied With The Equipment, The Contractor Is Obliged To Grant A Non-Exclusive License To The Ordering Party Or To Transfer To The Ordering Party A Non-Exclusive License Right In Accordance With The Licensing Rules Specified By The Manufacturer.9. The Contractor Will Provide Service And Technical Support From The Day Following The Date Of Signing The Acceptance Protocol For The Period Indicated In The Description Of The Subject Of The Order Constituting Annex No. 4 To Swz.10. In The Event Of A Complaint About The Quality Of The Delivered Equipment Or The Non-Compliance Of The Goods With The Order Or With The Swz, The Ordering Party Requests, Under The Warranty, The Replacement Of The Goods With A New One Corresponding To The Parameters Described In The Swz. 11. In The Event Of Untimely Or Lack Of Deliveries Due To The Fault Of The Contractor Or The Contractors
