3 The Offered Equipment Must Be Brand New And Come From Official Distribution Channels. 3. In Order To Limit The Amount Of Waste, The Employer Allows The Use Of Collective Packaging. 4. The Contracting Authority Provides For The Performance Of The Subject Of The Contract With The Possible Application By The Ordering Party Of The Rights Of The Options Referred To In Art. 441 Of The Pzp Act, Increasing The Subject Of The Contract By No More Than:  40 Pcs The Contractor Is Not Entitled To Any Claims Against The Employer, If The Contracting Authority Does Not Use The Right Options. 6. Rules For The Implementation Of The Subject Of The Contract Covered By The Law Regarding: The Manner Of Its Implementation, Its Acceptance, Required Standards And Technical Conditions, Method Of Payment, Method Of Security, Method Of Calculating Contractual Penalties, Performing Rights And Obligations Arising From The Warranty And Cooperation Of The Parties Will Be The Same As Those That Apply To The Basic Subject Of The Contract. The Employer May Exercise The Right Of Options Once Or Several Times, For Different Computer Equipment, While The Total Amount Of Computer Equipment May Not Exceed The Maximum Amount Of Computer Equipment Indicated In Paragraph 4, And The Deadline Specified In The First Sentence 8. If The Contracting Authority Exercises The Right Of The Option, The Delivery Carried Out As Part Of The Option, Computer Equipment Must Be Made And Delivered Within 45 Days From The Date Of Sending To The Contractor By The Contracting Authority In Writing Informing About The Exercise Of The Right Option, In Which The Amount And Type Of Equipment Or The Total Value For The Given Order Will Be Indicated. 9. A Detailed Description Of The Subject Of The Contract Was Specified In The Description Of The Subject Of The Contract Constituting Annex 1 To Swz And In The Draft Contract Constituting Annex 2 To Swz.10. The Contracting Authority Does Not Divide The Order Into Parts. The Contracting Authority Does Not Allow The Possibility Of Dividing The Order Into Parts Due To The Fact That The Monitor Is A Set With Notebooks And Therefore There Is A Real Risk That In The Event Of Only One Of The Elements, The Whole Set Would Not Meet The Functionality Required By The Contracting Authority. The Size And Scope Of The Order Is Not A Barrier To Contractors, Including Small And Medium -Sized Enterprises Operating On The Market.
