1. The Subject Of This Procedure Is The Purchase And Delivery Of A Brand New Tractor With Accessories As Well As Trailers And Barrels For Drinking Water In Accordance With The Requirements And On The Terms Indicated In The Description Of The Subject Of The Contract (Annex 4 To Swz), And Delivering Them To The Indicated Place In The Commune Of Sędziszów Małopolski. 2. The Purchase Is Implemented On The Basis Of Initially Granted Funds By The Podkarpackie Voivode, As Part Of The Civil Protection And Civil Defense Program For 2025-2026, Adopted By Resolution No. 72 Of The Council Of Ministers Of May 27, 2025 (M.P. Of 4 June 2025, Item 541), The Contracting Authority Reserves The Right To Annul The Proceedings In The Event Of Withdrawal Of Co-Financing. 3. A Detailed Description And Scope Of The Contract Is Specified In: Annex 4 To Swz.4. The Supplied Equipment Must: 1) Be Factory New, Undamaged, Free From Defects, Complete, Manufactured Not Earlier Than 2025, Fully Technically Functional, Fit For Proper Operation In Accordance With The Functional Scope And Purpose, 2) Constitute The Exclusive Ownership Of The Contractor And Be Free From The Rights And Claims Of Third Parties, 3) Have Relevant Documents (Certificate, Safety Attest Or Declaration Of Manufacturers Compliance Confirming Compliance Meeting Requirements, Manufacturers Catalog Cards Containing All Technical And Operational Parameters, Etc.). The Use Of Materials Or Devices Without Finding Their Origin Is Unacceptable. Installation Of Materials Or Devices That Will Not Meet The Abovementioned The Requirements Will Result In Absolute Dismantling At The Contractors Expense And With The Effects Resulting From It. 70S Of The Road Traffic Act.
