The Subject Of The Contract Is The Service Of Developing Expertise, Analyzes, Opinions And Documents Enabling Energy And Settlements Between Skb Members Together With Substantive And Legal Advice. 2. The Subject Of The Contract Is Divided Into Two Stages: 1) The Stage Of Analyzes, Expertise, Opinions And Documents Enabling The Conduct Of Energy Activities And Settlements Between Skb Members, In Recommended Variants Agreed With The Employer, Including In Particular: A) Legal Analysis Of The Possibility Of Concluding Direct Energy Purchase Contracts By The Coordinator Of The Cluster From Another Cluster For The Needs Of The Coordinator For The Needs (Auto -Consumption) Along With Balance And Settlement Of Energy Over The Network (E.G. In The Gud Model, Using A Dedicated Newly Built Direct Line Or Other Model Dedicated To The Energy Community). The Requirement Of Auto-Consumption For The Coordinator May Result From Restrictions Related To The Permissible Public Assistance Related To The Implementation Of The Project Cluster From Kpo Funds (Only To The Scope Of Support For Tasks Exempt From Public Aid As Dedicated Only To Water Supply And Sewage Activities); B) Legal Analysis A Targeted Company From Members Of The Cluster For The Needs Of The Entire Skb Community Performed On Its Own Or Using An External Entity-Energy Trading On The Principle Of Outsourcing; C) Recommendation Of The Organizational And Legal Model For Energy Trade By The Coordinator Of The Cluster Or A Special Purpose Company (Under The Skb Energy Community) Together With The Implementation Schedule. The Stage Implementation Of The Project Is Assumed, Starting With A Smaller, Model Implementation With A Smaller Volume Of Energy And The Number Of Partners Up To Full Implementation Covering All Members Of The Cluster; D) Legal Analysis In The Field Of Electricity Trading By The Coordinator Of The Cluster Or A Special Purpose Company In Terms Of Acceptable Public Aid, Taking Into Account The Previously Received Support. Cluster With A Recommendation Of Price Models For Use In The Contract For The Purchase Of Energy, In Particular For The Following Cases: • Purchase Of Energy By The Coordinator Or A Deliberate Company From A Private (Private Investor) Member Of The Cluster (E.G. Baltic Wind Group, Engie Ec Słupsk) Using Your Own Sn; • Purchase Of Electricity By Jst (E.G. City Of Słupsk) From Public (E.G. Wodociągi Słupsk) And A Non -Public Cluster Member (E.G. Baltic Wind Or Engie Ec Słupsk Group) - With An Analysis Of Restrictions Arising From Public Procurement Law; • Purchase Of Electricity Together With The Service Of Balancing By A Member Of The Cluster (Public And Private) From The Coordinator Of The Cluster And/Or Aggregator (I.E. Wodociągi Słupsk Or Targeted Company) Using Own Distribution Network; • Purchase Of Electricity Along With The Service Of Balancing By A Cluster Member From The Coordinator Of The Cluster And/Or Aggregator (E.G. Wodociągi Słupsk Or A Targeted Company)
