1. The Subject Of The Order Is The Supply Of Electricity For The Needs Of Eco Team Service Sp. Z O.O. In The Planned Quantity: 540,040.00 Kwh (540.040 Mwh), Including In The Scope Of The Osd Tariff Group: 1) C21 - 101 690.00 Kwh (101.690 Mwh); 2) C11 - 368 050.00 Kwh (368,050 Mwh); 3) C12b - 37 960.00 Kwh (38,960 Mwh); 4) G12 - 460.00 (0.460 Mwh); 5) C13 - 31 880.00 Kwh (31.880 Mwh); In The Period From January 1, 2026 To December 31, 2026, For The Collection Points Specified In Annex 5 To Swz. 2 Determining The Expected Energy Consumption Serves To Choose The Best Offer And Does Not Constitute On The Part Of The Contracting Authority A Commitment To Buy Electricity In The Quantities Given. The Employer Reserves The Right To Change The Quantity, Without Having To Change The Terms Of The Contract And To Prepare An Annex To The Contract. The Actual Energy Consumption (Smaller Or Greater Than The Forecast Of Energy Consumption Indicated In Annex 5 To Swz) Will Depend Only On The Actual Needs Of The Contracting Authority, Except That, Regardless Of The Size Of The Consumption, The Contractor Is Obliged To Use Energy Prices Offered In The Offer. The Contractor Agrees To The Above. 3. Energy Supply Will Be Settled On The Basis Of Actual Energy Consumption (Indications Of Measuring Systems) According To The Prices And Rates Of Fees Resulting From The Submitted Offer. 4. The Supply Of Electricity Will Be Carried Out On The Basis Of A Sales Contract Referred To In Art. 5 Para. 2 Of The Act Of 10 April 1997 - Energy Law (I.E., Journal Of Laws Of 2024, Item 266, As Amended)) - Hereinafter Referred To As The Act - Energy Law. 5 This Order Does Not Include The Provision Of Electricity Distribution Services. 6. The Contractor Will Ensure The Sale Of Electricity In Accordance With Applicable Quality Standards For The Service Of Recipients Specified In The Executive Files Issued On The Basis Of The Energy Law. The Condition For Commencement Of Deliveries Is To Effectively Carry Out The Procedure For Changing The Seller. 7. The Contractor Is Obliged To Perform The Obligations Of The Entity Responsible For Trade Balancing For Electricity Sold As Part Of The Subject Of The Contract. 8. The Contractor Must Have A Current Contract Or Promise Or A Statement About Having A Contract With The Osd Distribution System Operator, I.E. Tauron Dystrybucja S.A. Enabling The Sale Of Electricity Via The Dso Distribution Network To The Ordering Points Of The Ordering Party. 9. The Selected Contractor Will Prepare, Complete And Send Through The Appropriate Platform For The Exchange Of Information (Belonging To The Local Osd) Reporting The Sale Of Electricity (And On Behalf Of The Employer Will Report The Need To Conclude New Contracts For The Distribution Of Electricity, If Necessary) To All Electricity Consumption Points (Listed In Annex 5 To Swz) To The Swz Operator) To The Distribution System Operator (Tauron Dystrybucy S.A.) - In Order To Obtain Their Positive Verification As At
