The Scope Of The Order Also Includes: • The Crew Training By The Contractor At The Headquarters Of The Ordering Party In The Field Of Ongoing Service Of The Delivered Machine; • Service Reviews (Not Regarding The Current Maintenance Of The Machine In Good Condition) In Intervals Recommended And Recommended By The Manufacturer During The Warranty Period Proposed By The Contractor (Operational Materials, Labor, Travel To The Ordering Party). If The Description Of The Subject Of The Contract Indicates Any Trademark, Patent Or Origin, Source Or Special Process That Characterizes The Products Or Services Provided By A Specific Contractor - It Should Be Assumed That The Contracting Authority Gave Such A Description To Determine The Standard And Determine The Minimum Parameters That The Products Must Be Met By The Products To Meet The Requirements Set By The Contracting Authority And They Only Constitute A Qualitative Model Of The Subject Of The Contract. Pursuant To Art. 99 Para. 5 Of The Public Procurement Law, The Employer Allows Equivalent Products, Provided That The Subject Of The Offer Is Identical To Functionally And Has Technical Parameters (In Particular: Construction, Materials Used, Size, Etc.) And Utilitarian Not Worse Than Specified In Swz, And Is Also In Line With Applicable Legal Requirements. The Contracting Authority Will Take Into Account The Parameters Indicated In The Description Of The Subject Of The Contract. If The Contracting Authority Described The Subject Of The Contract By Reference To The Standards, European Technical Assessments, Approval, Technical Specifications And Technical Reference Systems, They Should Be Understood As Examples. The Contracting Authority In Accordance With Art. 101 Para. 4 Pzp Allows The Use Of Equivalent Solutions Described In The Content Of Swz. Each Time It Is Indicated In This Swz Or Attachments To Swz Norma, It Should Be Assumed That In Relation To It Used Or Equivalent. The Contractor, Who Refers To Equivalent Solutions Described By The Contracting Authority, Is Obliged To Show That The Offered Deliveries Meet The Requirements Set By The Employer. In Particular, The Contractor Is Obliged To Submit To The Ordering Party Together With The Offer A Detailed Description Of The Equivalent Solution Offered. 4. On The Importance Of The Subject Of The Order According To The Joint Dictionary Of Cpv Orders: 43260000-3-Excavators, Carvils And Chargers And Mining Machines 5. The Contractor Will Guarantee And Warranty For The Minimum Period Indicated By The Ordering Party, I.E. For A Period Of Min. 24 Months In The Event Of The Contractors Failure To Offer The Warranty Period And Warranty, Or When The Contractor Gives A Shorter Warranty And Warranty Period Than The Above, The Contractors Offer Will Be Rejected. The Warranty And Warranty Period Is A Criterion For Evaluation Of Offers.
