Construction Work-Framework Agreement For Network Moderation // Planning/Establishment/Entertainment/Conversion/Dismantling Of Locations Of The Bos-Digital Radio In Hamburg. See Framework Agreement § 5, Section 5.4: The Parties Agree On A Contractual Penalty For Each Location -Related Mandate For Which A Contract Period For The Execution Of The Services Of The Contractor Applies In Accordance With Section 5.1 And Section 5.2. In The Event Of Culpable Exceeding The Applicable Contract Period, The Contractor Has To Pay 0.2 % Of The Proportionate Net Order Amount In Relation To The Service Section, For Which The Contractor Exceeded The Contract Period, As A Contractual Penalty For Each Working Day Of Delay, But At Most 5 % Of The Net Order Amount. Further Claims For Damages By The Client Due To The Contractors Delay Remain Unaffected; The Contractual Penalty Is Counted Towards Such Claims For Damages. The Client Can Assert The Contractual Penalty Until The Final Payment.
