The Subject Of The Contract Includes The Modernization Of The Water Level Of The Nysa Ujście, I.E. The Staining Building Together With The Accompanying Infrastructure, As Well As Locks And Control Rooms Along With The Reconstruction Of The Avantports And Accompanying Facilities. A Detailed Description Of The Subject Of The Contract Is Included In Annex 1 To Swz. Equivalent Solutions. If In The Description Of The Subject Of The Contract Or Other Documents Of Proceedings Used To Describe The Subject Of The Contract For The Performance Of Construction Works, There Are Any Trademarks, Patents Or Origin, Sources Or Special Processes That Characterize Products Or Services Provided By A Specific Contractor, The Contracting Authority Allows Equivalent Solutions (Or Equivalent - In Accordance With Article 101 (4) Of The Pzp Act). They Apply To All Elements / Components Of The Description Of The Subject Of The Contract In These Proceedings, Which Are Required From The Contractor. The Rules For Assessing Equivalent Solutions In Force In These Proceedings Include The Scope Of Examination And Assessment Of Offers, Where Not Completing All Elements Of This Description May Be The Basis For Rejecting The Offer Pursuant To Art. 226 Paragraph 1 Point 5 Of The Pzp Act. The Rules For Assessing The Equivalent Solution Will Also Apply During The Implementation Of The Contract, Where In The Event Of An Intention To Introduce During Its Implementation The Equivalent Solution Provided For By The Provisions Of This Swz And The Description Of The Subject Of The Contract, Among Others, Whether The Contracting Authority May Allow An Equivalent Solution Or Not (Article 454 Of The Pzp Act). A Similar Rule Applies In Cases Where The Description Of The Subject Of The Contract Has Been Carried Out To Norms, European Technical Assessments, Approval, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Para. 1 Point 2 And Para. 3 Of The Pzp Act. Offering Equivalent Solutions To The Subject Of The Contract Indicated In The Description, It Also Requires Demonstrating That The Offered Solution Is Equivalent To Technical, Exploitation And Utility Parameters Not Worse Than Those Required By The Employer. The Burden Of Demonstrating The Fulfillment Of These Requirements Lies With The Contractor In The Submitted Offer Or If This Case Takes Place During The Performance Of The Contract - At The Time Of The Need To Make Such A Change.
