The Subject Of This Public Procurement Is Construction Within The Meaning Of Art. 3, Para. 1, Item 1 Of The Public Procurement Act. The Subject Of The Public Procurement Is Exceeded: Playground Located In Rle I -For Physical Culture And Sports, Sq.134G, According To The Plan Of Elin Pelin, Elin Pelin Municipality, District Of Sofia District The Contracting Authority Through The Advertisement For The Collection Of Tenders Under The Public Procurement Act Is The Mayor Of Elin Pelin Municipality, With The Total Estimated Value Of The Contract Amounting To Bgn 296,000.00 (Two Hundred Ninety Six Thousand Levs And 00 St.) Without Incl. Vat. At The Time Of The Initiation Of The Procedure, No Funding Was Provided And In Accordance With Art. 114 Of The Public Procurement Act, The Implementation Of The Contract Will Be Deemed To Be Awarded Under The Deferred Condition After Financing Provided. In The Event That No Financing Is Provided The Activities Subject To The Public Procurement Will Not Be Implemented. In This Case, None Of The Parties (Elin Pelin Municipality And The Contractor) Owes Compensation For Damages Or Lost Benefits To The Other Party. In The Event That No Full Funding Is Provided, The Contracting Authority Has The Right To Outsource The Implementation Of Part Of The Contract Activities, Up To The Amount Of The Partial Financing Provided. The Estimated Value Of The Public Procurement Is Determined By The Contracting Authority, Is In Accordance With The Market Value Of The Upcoming Activities And Includes All Payments Without The Value Added Tax (Vat) To The Future Contractor Of The Contract. The Deadline For Implementation Is Not More Than 3 (Three) Months, But Not Later Than 31.12.2025 And Begins To Run From The Date Of Signing A Protocol For The Opening Of A Construction Site And Determination Of The Construction Line And Level In Accordance With Ordinance No. 3 Of 31.07.2003 For Drafting Acts And Protocols During Construction. Category Of Construction: The Construction Falls In The Fifth Category According To Art. 137, Para. 1, Item 5, Letter A Of The Spatial Planning Act And Art. The Present Site Has Been Issued A Building Permit №191/14.08.2025, Issued By The Chief Architect Of The Municipality Of Elin Pelin;
