1. The Subject Of The Order Is The Delivery Of A Backhoe Loader And A Trail Milling Machine As Part Of The Project Entitled Expanding And Retrofitting Infrastructure Of Population Protection In The Iława Poviat. 2. Subject Of The Contract: 1) Part 1 - Backhoper - Subject Of Part 1 Includes Delivery: A) Factory New Backhoe Loader - 1 Item, Year Of Production: 2025, B) A Detailed Description Of The Subject Of The Contract In This Procedure And The Minimum Technical Parameters Are Specified In Annex 1A To Swz, C) The Selected Contractor Obliged To Instruct At Least 2 Persons Indicated By The Ordering Party In The Ordering Party In Time Of Not Less Than 1 Hour (1 Hour = 60 Min); 3. The Contractor Is Obliged To Provide Information On The Offered Devices (Equipment)/ Products, Specified In Point 1, In Col. 5 Of The Offer Form - Annex 1A -1B To Swz For Individual Elements Of The Subject Of The Contract. The Information Provided Must Refer To The Offered Devices/Products. This Information Must Be So Detailed That In The Event Of Various Configurations Of Devices/Products It Is Possible To Clearly State Which Device/Product Is Offered By The Contractor. 4. The Contractors Offer, Who Will Not Provide The Information Referred To In Paragraph 3, Will Be Rejected, Pursuant To Art. 226 Section 1 Item 5 Of The Public Procurement Law. 5. The Employer Reserves The Right To Verify The Compliance Of The Offered Solutions With A Description Of The Subject Of The Contract Based On Public Data, In Case Of Doubt Whether The Devices/Products Offered Is In Accordance With The Description Of The Subject Of The Contract, The Contracting Authority May Exercise The Right To Call The Contractor To Submit Explanations. 6. Common Requirements Relating To The Subject Of The Contract Regarding Part 1-2: 1) The Subject Of The Contract Includes The Supply Of Factory New Devices/Products With The Necessary Cabling, Service, With Parameters Not Worse Than Those Indicated In Annex 1A-1B To Swz; 2) By Factory New Means - Just Made, Not Used, Not Damaged, Recently Purchased, Freshly Created, Not Refrabsed, Factory -Packed Without Interference Of Third Parties. At The Same Time, The Contracting Authority Explains That By Third Parties He Understands Entities Not Authorized Service Of Offered Devices Or A Service Partner Of The Offered Devices. 3) Delivered Devices/Products Must Have A User Manual In Polish; 4) Delivered Products/Devices Must Be Manufactured Not Earlier Than 12 Months Before Delivery And Not Used Before The Date Of Delivery, Excluding The Use Of Their Correct Work Necessary To Conduct The Test (Applies To Part 2); 5) Supplied Products/Equipment/Equipment Must Be Complete And Technically Efficient, Free From Physical And Legal Defects, And Come From The Official Manufacturers Sales Channel To The European Union Market; 6) All Accessories, Wires, Other Elements Necessary To Start And Proper Use, Should Be Attached To All Devices/Products/Equipment; 7) The Contractor Underta
