The Employer Reserves That The Provided Subject Of The Contract Referred To Above Must Have Currently Required By Law, E.G. Permit, Certificates, Certificates, Approvals And In The Case Of Registration As A Medical Product, Marking Provided For By The Provisions Of The Act On Medical Devices Providing The Required Approval For Use And Trading In Poland In Accordance With The Ordinance Of The Minister Of Health On Basic Requirements And Procedures For Assessing Compliance Medical Devices. 3. The Purpose Of This Procedure Is To Receive A Product With Technical, Quality, Operational And Functional Parameters Specified In Swz, And Not The Purchase Of A Product Of A Specific Brand Or Manufacturer. For These Reasons, The Employer Has Made Due Diligence So That The Subject Of The Contract Is Not Described By Indicating Trademarks, Patents Or Origin, Source Or A Special Process That Could Lead To The Privilege Or Elimination Of Some Contractors Or Products. If, Despite This, It Turns Out That In Any Place Swz And The Attachments There Are Such Indications, They Should Not Be Treated As Requirements Related To The Subject Of The Contract, And They Should Be Considered Only In Terms Of Information Indications (Not Binding For Contractors). For These Reasons, An Offer That Will Not Correspond To Such Indications Will Not Be Considered Incompatible With The Content Of Swz And Will Not Be Rejected For These Reasons. 6. The Subject Of The Order Must Be Marked By The Manufacturer In Such A Way That It Is Possible To Identify Both The Product And The Manufacturer. 7. The Terms Of The Contract Are Included In The Draft Contract, Which Is Annex 5 To Swz.
