Machines And Apparatus For Testing And Measuring-Delivery Of An Integrated Set For Analyzing Volatile Organic Compounds Including Gas Chromatograph With Detection Using Mass Spectrometry (Gc-Ms/Ms) And Fid Detector, With A Headspace Attachment And Gas Generators, Controlled From The External Pc Set With Software With Its Installation And Training Staff. 1. The Subject Of The Order Is The Delivery Of An Integrated Set For Analyzing Volatile Organic Compounds, Including Gas Chromatograph With Detection Using Mass Spectrometry (Gc-Ms/Ms) And A Flame-Onxual Detector (Fid), With A Headspace And Gas Generators, Controlled From The External Pc Set With Software, Together With Its Installation, Including Training Of The Ordering Persons Personnel. 2. A Detailed Description Of The Subject Of The Contract Was Included In Annex 1 (Opz) And Annex 7 To Swz (Planned Provisions Of The Contract). 3. The Ordering Party Does Not Divide The Order Into Parts And Thus Does Not Allow Partial Offers. Justification: The Order Is Fully Adapted To The Needs Of Small And Medium -Sized Enterprises Within The Meaning Of The Annex I To The Commission Regulation (Eu) No 651/2014 Of 17 June 2014. The Purpose Of The Order Is To Ensure A Comprehensive And Compatible Set For Preparation And Analysis Of Environmental And Organic Samples. The Lack Of Division Of The Order Into Parts Reduces The Risk Of Technological Non -Compliance Between Individual Elements Of The System And Simplifies The Implementation Process - From Delivery, Through Installation, To The Launch And Training Of Staff, Also Eliminates The Need To Coordinate The Activities Of Various Contractors, Which Would Involve Additional Excessive Costs And Organizational Difficulties, And As A Consequence Could Threaten The Timely And Correct Performance Of The Order. Due To The Principle Of Rational Spending Of Funds By The Ordering Party, The Division Of The Order Into Parts Is Unprecedented. 4. If, When Describing The Subject Of The Contract, The Contracting Authority Refers To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Para. 2 And Para. 3 Of The Pzp Act, Equivalent To Described Solutions Are Allowed. Each Return In Swz Relating To Standards, Technical Assessments, Technical Specifications And Technical Reference System Should Be Read With An Accompanying Or Equivalent Attention. 5. In The Event That In The Description Of The Subject Of The Contract There Are Indications Of Trademarks, Patents Or Origin, They Should Be Understood In Accordance With Art. 99 Para. 5-6 Of The Public Procurement Law, That This Is Justified By The Specificity Of The Subject Of The Contract And The Contracting Authority May Not Describe The Subject Of The Contract Using Sufficiently Accurate Terms. In Such Circumstances, The Employer Allows The Possibility Of Submitting Equivalent Solutions In The Offer, Indicating That The Minimum Requirements To Be Met By Equivalent Solutions Are The Requirements (Functionalities) No Worse Than The Parameters (Functionality) Indicated In The Description Of The Subject Of The Contract. The Contractor, Who Refers To Equivalent Solutions Described By The Contracting Authority, Is Obliged To Show That The Deliveries He Offers Meet The Requirements Set By The Employer. 6. Pursuant To Art. 101 Para. 5 Of The Popp In The Event That The Subject Of The Contract Offered By The Contractor Refers To Equivalent Standards
