Part 1: Defibrillators - 2 Pcs. 2. The Subject Of The Contract Is Delivery Of Medical Equipment For The Needs Of Wspr Spzoz In Łomża. 3. The Subject Of The Contract Was Specified In Detail In Swz And In The Attachments To Swz, And In Particular In The Required Border Technical Conditions For Medical Equipment And The Assortment Form (Gwtifa) Constituting Annex 2 To Swz And In The Planned Provisions Of The Contract, Constituting Annex 6 To Swz.4. The Offered Medical Equipment Must Be Brand New (Year Of Production Min. 2025), Marked With The Manufacturers Name And Character Identifying The Product, It Must Be Free From Any Physical Or Legal Defects, Approved For Trading On The Basis Of Applicable Law, In Particular It Must Meet The Requirements Set Out In The Act Of 20 May 2010 On Medical Products (Journal Of Laws Of 2024, Item 1620, As Amended) Have Certificates, Approvals (If The Need To Have Them Results From The Law), It Must Have A Ce Declaration, It Must Be Delivered In Conditions Appropriate For Its Transport And Contain A Description Of The Properties And Rules Of Use, The Instruction Manual For The Device In Polish, As Well As Other Leaflets In Polish Containing All Necessary Information For Direct Use. The Contractor Undertakes To Provide Current Documents Regarding The Offered Equipment At Each Request Of The Ordering Party. 5. In Addition, The Contractor Undertakes To Conduct Training Of The Employers Personnel In The Field Of Proper Operation Of The Offered Medical Equipment, As Well As Must Provide The Necessary Equipment To Conduct Training At The Ordering Partys Headquarters And Consumables (So -Called Starter Package, If Required). 6. If The Description Of The Subject Of The Contract Includes Any Trademarks, Patents Or Origin Of The Source Or A Special Process That Characterizes The Products Supplied By A Specific Contractor - It Should Be Assumed That The Contracting Authority Gave A Description With An Indication Of The Type And Allows Submitting Bids Equivalent To Parameters Not Worse Than Those That Were Given In The Description Of The Subject Of The Order (Legal Basis - Article 99 (5)). 7 If There Are Norms, Technical Assessments, Technical Specifications Or Technical Reference Systems Referred To In Art. 101 Para. 1 Point 2 And Para. 3 Of The Act, This Should Only Be Treated As A Help In Describing The Subject Of The Contract. In Each Case, Equivalent Solutions Are Permissible. The Employer Will Not Reject The Offer For The Lack Of Compliance With The Above -Mentioned Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Para. 1 Point 2 And Para. 3 Of The Act, Provided That The Contractor Proves In The Offer, In Particular By Means Of The Means Of Evidence, That The Proposed Solutions To An Equivalent Extent Meet The Requirements Set Out In The Description Of The Subject Of The Contract (Legal Basis - Article 101 (5) Of The Act).
