The Subject Of The Contract Is The Delivery Of 40 Perpetual License Licenses Of The Microsoft Office Standard Ltsc 2024 Office Software Together With Delivery To The Ordering Office Or Equivalent Software. 2. A Detailed Description Of The Subject Of The Contract Is Included In Annex 4 To Swz (Description Of The Subject Of The Contract). 3. Equivalence: A) The Ordering Party, In The Case Of Describing The Subject Of The Contract By Means Of Trademarks, Standards, Patents Or Origin, Source Or Special Process Referred To In Art. 101 Para. 4-5 Of The Act, Indicates That It Allows Equivalent Solutions Described In The Scope Of The Technical Solutions Adopted, The Materials Used, The Products, The Standards, Provided That The Proposed In The Offer Are Significantly Equivalent To The Designated In The Design Documentation. B) If There Are Any Trademarks, Patents, Standards Or Other Rights Reserved Or Exclusive, Or The Origin Of The Subject Of The Contract Or Part Of It - There Should Be Or Its Part - That The Contracting Authority, Due To The Specificity Of The Subject Of The Contract, Provided Such A Description With An Indication Of The Type And Allows The Submission Of Equivalent Offers In Terms Of Functional Terms And With Technical And Utility Parameters Not Worse Than Those Given In The Description Of The Subject Of The Contract. In The Case Of Submitting An Offer Containing The Use Of Equivalent Solutions To Those Described By The Employer, The Obligation To Prove Their Equivalence With The Requirements Indicated By The Contracting Authority, Lies With The Contractor. In This Case, The Contractor And The Offer (Not Being Supplemented) Will Submit A List Of Equivalent Materials Along With Other Necessary Documents Confirming The Fulfillment Of The Above -Mentioned Requirements, E.G. Devices Cards, Safety Certificates, Conformity Declarations, Technical Approvals, Etc. C) As Equivalent, In Terms Of Functional, Technical And Utility, Compared To The Indicated Subject Of The Contract, The Contracting Authority Will Recognize Such Products That Have Technically Equivalent Structure And Equipment, As Well As Such Functional Possibilities And Technical Parameters, As Contained In The Description Of The Subject Of The Contract, Products With Given Reference Parameters. D) The Contracting Authority Has Made Every Effort To Maintain Competitiveness Conditions. If, Despite This, In The Text Of Any Type Of Documentation Own Names, Markings Or Parameters Indicating A Specific Product Should Always Be Treated As Sample Solutions And You Can Use Equivalent Solutions On The Conditions Adopted Above. E) If The Contractor Does Not Submit Documents About The Use Of Other Materials And Devices, It Is Understood By The Fact That Materials And Devices Proposed In The Description Of The Subject Of The Contract Have Been Included In The Price Calculation Of The Offer Price.
