Particular Offers To Selected Items Will Be Rejected. 1. The Contracting Authority Does Not Allow Partial Offers. 2. Description Of The Subject Of The Contract, Size And Scope: The Subject Of The Contract Is The Supply Of Electricity In Accordance With The Provisions Of The Act Of 10 April 1997 Energy Law (I.E., Journal Of Laws Of 2024, Item 266, As Amended) In The Period On 01.01.2026 - 31/12/2026 It Is 1,161,782 Mwh.3. Description Of The Subject Of The Contract Is Included In Annex 1 To Swz. The Planned Provisions Of The Contract Are Included In Annex 4 To Swz Together With Annex 1 (List Of Electricity Consumption Points Covered By The Contract) And No. 2 (Power Of Attorney). 4. The Description Of The Subject Of The Contract Specifies The Qualitative Standards Related To All Relevant Features Of The Subject Of The Contract (The Subject Of The Contract Is Standardized - It Will Be Implemented Identically, Regardless Of Which Contractor Performs It), All Costs Of The Life Cycle - Margin, Commercial Balance Costs, Transaction Fees, Transaction Fees, Profile Variability Costs, Graphic Resources, Graphics Costs, Conventional Energy Costs, And Property Rights Costs, Excise Tax. Apart From The Above The Contracting Authority Does Not Provide For Other Costs Of Electricity Supply. 5. The Contracting Authority Did Not Divide The Contract Into Parts For The Following Reasons: A) One Of The Motives Of Directive 2004/18/Ec Of The European Parliament And Of The Council Of 31 March 2004 On The Coordination Of The Procedures For The Award Of Public Procurement For Construction Works, Deliveries And Services (Journal Of Laws L 134 Of 30.4.2004, P. 114), Hereinafter Referred To As The Directive The Potential Of Small And Medium -Sized Enterprises (Smes) And Facilitating Their Participation In The Public Procurement Market; In The Case Of Orders For The Supply Of Electricity, Regardless Of The Completion Or Failure To Divide The Order Into Parts Of The Potential Circle Of Electricity Suppliers, It Will Remain Unchanged - In Accordance With Polish Provisions, Entities Performing Activities In The Field Of Electricity Sales Are Obliged To Obtain A License For Electricity Trading, Issued By The President Of The Energy Regulatory Office; In Connection With The Above, The Failure Of The Division Of The Contract By The Ordering Party Does Not Limit The Share Of Small And Medium -Sized Enterprises In The Public Procurement Market, And As A Consequence Is Not Contrary To The Motive Of The Directive Cited Above, B) The Contracting Authority Additionally Decided To Fail To Divide The Order Into Parts For The Reasons Resulting From The Specificity Of The Polish Electricity Market; By Accumulatin
