1. The Subject Of The Contract Is Delivery And Purchase Of A New Backhoe Loader As Part Of The Task: Retrofitting The Ropczyce Commune In Equipment Necessary For The Protection Of Population And The Functioning Of Civil Defense. The Task Is Implemented Based On A Targeted Subsidy For The Implementation Of Own/Commissioned Tasks Under The Civil Protection And Civil Defense Program For 2025-2026.2. The Backhoe Loader Will Be Delivered To The Ordering Party From The Official Authorized Distributor Of The Construction Machinery In Poland, A Factory New From The Year Of 2025, From Serial Production (Not A Prototype), Free From Physical And Legal Defects, Covered By The Manufacturers Warranty. 3. Backhoe Loader Must Meet The Requirements Of A Vehicle Allowed To Travel On Public Roads In Accordance With Applicable Provisions Of The Act - Road Traffic Law. 4. A Detailed Description Of The Subject Of The Contract, Including The Technical Description, The Contracting Authority Included In Annex 2 To Swz.5. The Contractor Is Obliged To Fill Out - Factory Specification Of The New Backhoe Loader - Item 2 Of The Offer Form Constituting Annex 1 To Swz. Selecting The No Or/Or Incomplete Completed Column Contractor Declaration May Cause The Contractor To Be Called To Explain Or Reject The Contractors Offer. 6. The Subject Of The Contract Should Be Delivered At Its Own Expense And Risk To The Headquarters Of Przedsiębiorstwo Usług Komunalnych In Ropczyce Along With Unloading In Place: 39-100 Ropczyce Ul. Przemysłowa 12.7. If The Description Of The Subject Of The Contract Uses Markings Or Parameters Indicating A Specific Manufacturer, A Specific Product, Trademarks, Patents Or Origin Were Indicated, The Contracting Authority Allows The Use Of Equivalent Solutions, By Which Products Should Be Understood As Products With Parameters Not Worse Than Presented In The Description Of The Subject Of The Contract And Meet At Least In The Same Scope Of The Contracting Authority. 8. If The Description Of The Subject Of The Contract Refer To Standards, European Technical Assessments, Approval, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Para. 1 Point 2 And Para. 3 Of The Pzp Act, The Contracting Authority Allows The Application Of Equivalent Solutions. 9. The Contractor Citing Equivalent Solutions Described By The Contracting Authority Is Obliged To Show In The Offer That The Products He Offers Meet The Requirements Of The Ordering Party. 10. Required Warranty Period Min. 36 Months Calculated From The Date Of The Final Reception Of The Subject Of The Contract. 11. The Contractor Is Obliged To Complete The Order On The Principles And Conditions Described In The Provisions Of The Contract Constituting Annex 3 To Swz.
