1. The Subject Of The Contract Is The Implementation Of The Design And Cost Documentation Of Two Multi-Family Residential Buildings At Tęczowa Street In Sokołów Małopolski Together With The Accompanying Infrastructure And Obtaining A Final Decision On The Building Permit And Other Documents Required By Law, As Well As Performing Authors Supervision During The Implementation Of Works Covered By The Project. Characteristics Of The Designed Object: 2. Location - Property Located At Tęczowa Street In Sokołów Małopolski, Consisting Of Plot No. 5330/97 With An Area Of 1.0579 Ha, Registration Precinct 0001 Sokołów Małopolski, Commune Of Sokołów Małopolski, Rzeszów Poviat, Podkarpackie Voivodeship. The Investment Area Is Covered By The Local Spatial Development Plan. Project And Scoop Documentation Should Be Made Based On The Current Local Spatial Development Plan (Hereinafter Pzp) For The Property In Question, Which Constitutes Annex 10 To Swz.3. As Part Of The Order, The Employer Requires The Preparation Of Project And Cost Documentation Based On The Documentation Of The Architectural And Construction Concept, Constituting Annexes 11 To Swz. The Order Also Includes The Design Of Accompanying Infrastructure In The Scope Of: Water Connection, Sanitary Sewage System, Rainwater Sewage System, Electrical Connection, Connecting To The Gas Network, Telecommunications Connection And Internal Installations: Water-Sewage, Central Heating, Electrical, Teletechnical And Ventilation. The Subject Of The Contract Should Be Carried Out Taking Into Account The Provisions Of The Local Spatial Development Plan In Force In The Sokołów Commune Of Lesser Poland, Description Of The Subject Of The Contract And Additional Requirements Of The Ordering Party, Contains Swz Together With Attachments. 4. The Contracting Authority Does Not Require Employment Based On The Employment Relationship In The Circumstances Referred To In Art. 95 Of The Public Procurement Law Act, The Indication Of Withdrawal As Part Of The Subject Of The Contract Is Performed By Persons Performing Independent Technical Functions In Construction Within The Meaning Of The Act Of 7 July 1994 Construction Law. People Are Independent Participants Of The Construction Process And Act Independently, Also In The Understanding That They Set Their Tasks Themselves And Carry Out These Tasks Themselves. The Above Does Not Complete The Conditions Specified In Art. 22 § 1 Of The Code Of Civil Procedure I.E. Performing A Specific Type Of Work For The Employer And Performing Work Under The Leadership Of The Employer, In A Place Designated By The Employer And At The Time Appointed By Him, As Well As The Employers Obligation To Employ An Employee For Remuneration. The Above Argument Justifies The Withdrawal From The Requirement Of Employment During The Implementation Of Persons On The Basis Of An Employment Relationship.
