The Subject Of The Contract Is The Successive Delivery Of Food Products For The Needs Of The School Dormitory In Kędzierzyn-Koźle Intended For The Needs Of Ongoing Nutrition In The Assortment And Quantities Included In Individual Parts Of The Order Specified In Annexes 1 ÷ 3. Part 1 - Meat And Sausage Description Of The Subject Of The Contract Is Determined By The Assortment And Percentage Form Annex 1 - Constituting An Integral Part Of Swz Published On The Proceedings Published On The Page. 1. The Subject Of The Order Are Successive Delivery Of Foods For The Needs Of Current Nutrition In The Assortment And Quantities Included In The Statements Constituting Attachments From No. 1 To No. 3. The Implementation Of The Deliveries Will Be Made Successively On The Basis Of The Demand Of The Ordering Entity, In Which The Delivery Date And The Order Assortment Will Be Determined Each Time - Excluding Non -Working Days And The Unit Ordering Party And Breaks Resulting From Days Off. The Employer Points Out That The Cyclical Deliveries For The Ordering Entity Should Be Adapted To The Placed Order Each Time. 2. The Contracting Entity Reserves The Right To Limit The Scope Of The Order In Individual Parts, While Maintaining The Minimum Value Of The Subject Of The Contract (Specified In The Concluded Contract) At The Level Of 10% Guaranteeing The Contractor Related To This Scope Of The Contract Remuneration. A Certain Number Of Foodstuffs In The Price Form Is An Estimate And May Change (Reduced Or Increase) During The Performance Of The Contract. The Above May Not Constitute Grounds For The Contractor To Bring Claims For The Purchase Of The Remaining Number Of Products Or For Payment Of The Equivalent Of Unimpressed Products Or Compensation For Their Failure. 3. Food Products Covered By Delivery Should Meet The Current Sanitary And Epidemiological Requirements And Haccp System Principles In Collective Nutrition Plants, Among Others: 1) Have Adequate Quality Specifications Or Approvals, 2) Have The Appropriate Marking, I.E. The Date Of Minimum Durability And The Date Of Shelf Life, 3) Have The Appropriate Temperature During Transport And Sanitary Conditions, Current Required Decisions Related To This. In The Event That Any Of The Previous Decisions Have Expired Or Have Been Withdrawn During The Period Of This Contract, The Contractor Is Obliged To Submit A New Decision In This Respect, No Later Than On The Last Day Of The Current One. Lack Of Any Required Document Confirming The Possession Of The Appropriate Valid Decision Or Failure To Complete The Documents Within The Deadline Set By The Entity, Will Constitute The Basis For Withdrawing From The Contract By The Contracting Entity With Immediate Effect And Calculating The Contractor Of The Contractual Penalty Referred To In § 10 Paragraph 1 Point 1.1 Of The Ppu Or Depending On The Decision Of The Contracting Entity To Suspend The Performance Of The Contract Until The Deficiencies Were Completed Within The Time
