To All The Requirements Of This Rfp No Changes Substitutions Or Other Alterations To The Rules And Provisions Stipulated In This Rfp May Be Made Or Assumed Except As Instructed Or Approved In Writing By Ecobank In The Form Of Supplemental Information To The Rfp By Submitting A Bid The Bidder Undertakes To Comply With All Obligations Stated In This Rfp And Unless Otherwise Provided Acknowledges To Have Read Understood And Agreed To All The Instructions In This Rfp Any Bid Submitted Will Be Regarded As An Offer By The Bidder And Does Not Constitute Or Imply The Acceptance Of Such Bid By Ecobank Additionally Ecobank Has No Obligation To Award A Framework Agreement To Any Bidder As A Result Of This Rfp Ecobank Implements A Policy Of Zero Tolerance On Prohibited Practices Including Fraud Corruption Collusion Unethical Practices And Obstruction Ecobank Is Committed To Preventing Identifying And Addressing All Acts Of Fraud And Corrupt Practices Against Ecobank And Third Parties One Or More Parties In This Tender Process If They Are Or Have Been Associated In The Past With A Firm Or Any Of Its Affiliates Which Have Been Engaged By Ecobank To Provide Services For The Preparation Of The Design Schedule Of Requirements And Technical Specifications Cost Analysis Estimation And Other Documents To Be Used For The Procurement Of The Atms And Related Services In This Selection Process Were Involved In The Preparation And Or Design Of The Project Related To The Atms And Related Services Requested Under This Rfp Or Are Found To Be In Conflict For Any Other Reason As May Be Established By Or At The Discretion Of Ecobank In The Event Of Any Uncertainty In Determining If A Circumstance Is Potentially A Conflict Of Interest Bidders Must Disclose Such Circumstance To Successful Bidder For This Rfp 8 1 The Bidder Should Be A Registered Company In A Financially Sound State As Judged By Ecobank For This Purpose A Copy Of The CompanyS Financial Statement For The Last Two Financial Years Should Be Submitted With The Offer 8 2 The Bidder Must Own A Company Directly Or Through Its Authorized Partners Support And Logistics Centers In The Countries Which They Are Applying For The Bidder Needs To Have Direct Support Personnel Presence In The Countries Such Branches Service Centers Should Have Been In Existence At Least For The Past 2 Years A List Of Service Centers With Complete Addresses Should Be Provided Including The Headcount In Those Centers 8 3 The Bidder Or His Authorized Partners Should Have At Least 3 Years Exposure In Supplying Installing Maintaining And Managing Atms And Provide Details Of 3 Largest Clients 8 4 The Bidder Should Have Qualified Project Management Personnel Team To Implement The Atm Deployment Project Total Number And Their Qualifications And Experiences To Be Provided 8 5 The Bidder Must Have A Direct Sales And Support Agreement With The Original Atm Manufacturer Oem The Bidder Must Include In The Bid A Copy Of The Agreement And A Letter Of Authority From The Oem Empowering Him To Quote On Behalf Of The Oem 6 3 Disclaimer All The Details Provided In This Rfp Or Any Information Provided Subsequently To Original Atm Manufacturers Oem Approved Partners Whether Verbally Or In Writing By Or On Behalf Of Ecobank Is Provided To Them On The Terms And Conditions Set Out In This Rfp Document And All Other Terms And Conditions Governing The Disclosure Of Such Information This Rfp Is Neither An Agreement Nor An Offer And Is Only A Request For Proposal That Will Be Formalized Through A Framework Agreement To Set Out The Final Prices Slas And Other Conditions Of Performance Of The Said Framework Agreement Thus The Purpose Of This Rfp Is To Provide The To Original Atm Manufacturers Oem Approved Partners His Own Additional Researches Investigations And Analysis And May Contact Ecobank During The Tender Period For Any Additional Information Needed Ecobank Makes No Representation Or Warranty And Shall Incur No Liability Under Any Law Statute Rules Or Regulations As To The Accuracy Reliability Or Completeness Of This Rfp Ecobank May At Its Absolute Discretion But Without Being Under Any Obligation To Do So Update Amend Or Supplement The Information In This Rfp Please Note This Is Not An Offer By Ecobank But Only A Request For Proposal In The Selection Process Initiated By The Bank And Which Request Clarification About Any Of The Rfp Documents No Later Than The Date Provided In The Schedule Of Events And Prior To The Bid Submission Date Any Request For Clarification Must Be Sent In Writing Via Mailing Or Email To The Ecobank Address Provided In The Data Sheet Ds No 12 Ecobank Will Respond In Writing By Email And Send Copies Of The Response Including An Explanation To The Question Without Mentioning The Author To All Bidders Who Have Provided Confirmation Of Their Intention To Submit A Bid Ecobank Shall Endeavor To Diligently Provide Such Responses But Any Delay In
