Tenders Are Invited For National Adviser To Develop The Draft Law On Alternative Methods Of Conflict Resolution Marc Restorative Justice Jr Reserved For Guinea Bissau Nationals BackgroundContext And Fundamentals Despite The Consecration Of Political Civil Economic And Social Rights Through The Constitution Laws Are Poorly Implemented Or Enforced Resulting In Limited And Inequitable Access To Justice Services By The Population And A Global Decline In Confidence In The Modern State System And In The Institutions Of Justice The State Has Not Been Able To Fulfill Its Mission Of Ensuring Justice And Security Throughout The Territory Particularly In Rural Areas And Especially For Women And Young People Children Since Independence There Has Been A Coexistence Of Formal Justice A System Based On The Official Law Inherited From The Settlers And From Traditional Forms Of Justice Based On Customary Law Which Was Recognized During The Colonial Period The So Called Formal Justice System Is Expensive Slow Poorly Managed And Yet Widely Discredited By The Public Being Seen By Many As Manipulated And Corrupt Serving Only The Needs Of The Most Powerful As A Result And For Historical And Cultural Reasons A Large Part Of The Population Uses Marc Most Disputes Are Settled By Local Conflict Resolution Institutions Including The Family The District Chiefs The Village Chief And Or The Tribal Chief Especially In Rural Areas Traditional Systems And Practices Based On Customary Law Are Still Very Much Present In Communities In Fact Traditional Norms Rather Than National Laws Are Applied In Most Cases And Are Often The Only Functional Justice Mechanism That People Have Access To And Rely On In Many Places For This Reason Customary Systems Are Crucial To The Delivery Of Justice In Guinea Bissau But They Often Make Decisions That Violate Regional And International Human Rights Standards And Are Discriminatory Against Vulnerable Groups Such As Women Youth And Children By Way Of Example Punitive Measures Applied By Locally Recognized Ombudsmen May Include Corporal Punishment Forced Marriage And Female Genital Mutilation These Practices Differ From Region To Region And According To Ethnic Groups And Or Religious Groups Conscious Of Its Limitation And The Need To Preserve Social Peace And Strengthen The Rule Of Law National Authorities Have Drawn Up A National Justice Reform Program 2015 2019 Focusing On A Justice Among Others This Program Foresees The Strengthening And Legal Recognition Of The Marc To Facilitate The Populations Access To Justice Thus The United Nations Development Program Undp Through A Project Funded By The United Nations Peacebuilding Fund Pbf Entitled Support For Political And Institutional Stabilization Of The Justice Sector For Peacebuilding In Guin Bissau With A Focus On Marc And Restorative Justice Jr Is Providing Support For The Implementation Of Justice Reform In This Context Duties And ResponsibilitiesObjective Of The Consultancy The Purpose Of This Consultancy Is To Produce A Bill On Marc Duties And Responsibilities The Consultant Under The General Supervision Of The Deputy Resident Representative Of Undp And The Technical Supervision Of The Chief Technical Adviser For Justice Reform Is Expected To Undertake The Following Tasks In Collaboration With An International Consultant Take Note Of The Documents Laws Available To Better Understand The Project Context And Objectives Of This Consultancy Review Legislation Available Internationally And In Guinea Bissau On Measures Used To Resolve Conflicts Marc Conduct A Comprehensive Review Of Existing Legislative Proposals In Guinea Bissau On Marc Prepare And Conduct Interviews Discussions With The Main Actors In The Justice Sector Ministry Of Justice And Human Rights Magistrates Technicians Of The Centers For Access To Justice Caj Etc At Both Central And Regional Level Prepare A Comprehensive Draft Law Applicable To The Guinea Bissau Context On Marc Organize A Presentation And Validation Session Of The Draft Law Proposal Through A Workshop With Stakeholders Contribute To The Finalization Of The Marc Bill Including The Comments Of The Validation Workshop Propose Appropriate Follow Up Initiatives Products Conceptual Note With A Clear Methodology And A Proposed Schedule Draft Law On Marc Jr Final Version Of The Law Proposal Including Suggestions From The Validation Workshop Final Report Duration Of The Consultancy The Consultancy Must Be Carried Out Within A Month 25 Working Days CompetenciesProfile Of Consultant Skills Strong Experience In Addressing Challenges In The Relationships Between Traditional And Formal Justice Systems Demonstrable Knowledge And Experience In The Field Of The Rule Of Law And Access To Justice Including Cross Cutting Issues Such As Human Rights Gender And Capacity Building And Rights Based Approaches Is Considered A Differentiating Factor Demonstrated Work Experience In Legal Matters In Guinea Bissau Experience In The Use Of Computers And Office Software As Well As In Virtual Management Systems Language Proficiency In Portuguese And Creole From Guinea Bissau Is Mandatory Proficiency Spoken And Written In French And Or English Is Considered A Plus Application Guidelines Mandatory Documents Without Which The Application Will Not Be Considered A Cover Letter Explaining Why You
