The Subject Of The Order Is A Service Within The Meaning Of Art. 7 Point 28 Of The Public Procurement Law, Consisting In: • Opening 70 Bicycle Stations (With 70 Totems), • Making 560 Pieces Of Brand New Standard Bicycles Available, • Making 140 Pieces Of Brand New Bicycles With Electric Support Available, • Developing Software, Including A Mobile Application And Website, • Implementing And Launching The Contact Center, • Launching, Managing And Comprehensive Operation Of A Self-Service Rental Shop Public Bicycles In Bydgoszcz, Operating Under The Name Bydgoski Rower Aglomeracyjny (Hereinafter Bra). 2. Outside The Basic Scope Of The Order, The Ordering Party Provides For The Possibility Of Using The Option In Full Or In Part. If The Ordering Party Uses The Option, Up To 30 Bicycle Stations (Up To 30 Totems) Will Be Launched And Up To 100 Standard Bicycles And Up To 50 Bicycles With Electric Assistance Will Be Made Available. A Detailed Description Of The Subject Of The Order (Basic And As Part Of The Option) And The Terms Of Execution Of The Order Are Included In The Draft Provisions Of The Contract With Annexes, Constituting Annex No. 1 To The Swz, Including The Description Of The Subject Of The Order (Opz) With Annexes, Constituting Annex No. 2 To The Draft Provisions Of The Agreement And In The Template Valuation Form For The Basic Order Constituting Annex No. 3_1 To The Swz And In The Template Valuation Forms For The Order Covered By The Option Constituting Annexes No. 3_2, 3_3, 3_4, 3_5 To The Swz. Procedure For Awarding An Order: 1. The Procedure Is Conducted On The Basis Of The Provisions Of The Public Procurement Law And In Matters Not Regulated By This Act On The Basis Of The Provisions Of The Civil Code. 2. The Ordering Party Awards The Contract In An Open Tender, Pursuant To Art. 132 Of The Public Procurement Law, In Which All Interested Contractors May Submit Offers In Response To The Contract Notice. 3. Pursuant To Art. 20 Section 1 And 2 Of The Pzp, The Contract Award Procedure Is Conducted In Writing, In Polish. 4. The Contractor Is Obliged To Apply The Legal Acts Referred To In The Tender Documentation In Their Applicable Wording. 5. The Ordering Party Will Apply The Procedure Referred To In Art. 139 Section 1 Pzp, I.E. The Ordering Party Will First Examine And Evaluate The Offers, And Then Subjectively Qualify The Contractor Whose Offer Was Rated The Highest In Terms Of The Lack Of Grounds For Exclusion And Compliance With The Conditions For Participation In The Procedure. 6. The Ordering Party Provides For The Possibility Of Invalidating The Proceedings In Question Pursuant To Art. 257 Point 1 Of The Public Procurement Law, If The Public Funds That The Ordering Party Intended To Use To Finance All Or Part Of The Contract Were Not Granted To It, And The Possibility Of Invalidating The Procedure On This Basis Was Provided For In The Contract Notice. 7. The Estimated Value Of The Contract In Question Exceeds The Eu Thresholds Referred To In Art. 3 Pzp.
